Gun Bans, Second Amendment, Executive Orders

“Dear Leader” Obama is flirting with Articles of Impeachment. The power of the Presidential Executive Order is simply not robust enough to amend the constitution.
Look. The 2nd Amendment is was it is… period. You want to change it? The process is simple, but very difficult. It was meant to be both.
You need the affirmative vote of 2/3rds of BOTH houses of Congress—and then—it goes to the people of the states where 3/4’s of the states must vote for it (in the affirmative) in order to ratify it.
Please note that at no time is the office of the President involved.
The man who would be “King of America” may not be pleased about this, but, hey, things are tough all over!
So far, Obama is playing his cards close to the chest and the MSM is, of course, aiding and abetting him—as is their wont for “progressive” (otherwise known as Marxist) presidents.
The thing is—we have been hearing unconfirmed rumors for months, even during the Presidential campaign that Presidential Executive Orders were in the making for gun control during Obama’s second term. Frankly, I would have been surprised had they not been in a state of, shall we say—“preparation”—during those months.
But Obama is going to have to tread softly ... VERY softly, indeed.
There ARE most certainly things Obama can order done with an EO. Neither amending the Constitution, or violating the Constitution, is among them.
In an Article at Mother Jones authors Tim Murphy and Adam Serwer offer fourteen things they say Obama can do without going through the Congress:
Appoint a full-time ATF director.
Prosecute people who try to buy guns illegally.
Add a second serial number to new guns or improve placement of the first one.
Background checks for gun dealers’ employees.
Don’t let dealers who lose their license retain inventory.
Make gun sellers report details of sales to manufacturers.
Stricter regulations on inventory.
Require agencies to fork over data on mental health and drugs.
Require the FBI to contact state and local agencies in case of mental health rejections.
Investigate thefts of five or more guns—and make states report them.
Require dealers to track all trace requests.
Use existing data to figure out which gun shows are the worst—and target them.
Create a special DOJ unit to track interstate gun trafficking, abetted by state agreements.
Enforce the 1968 Gun Control Act.
Obama and his cadre of legal eagles must know that anything he does administratively that even appears as if it is infringing upon the 2nd Amendment will draw fire and a possible move toward his impeachment. On January 14th, The Washington Times reported the following:
Rep. Steve Stockman threatened on Monday to defund the White House and potentially file impeachment charges if President Obama pushes forward with gun control measures without congressional approval.
The Texas Republican called Mr. Obama’s plans to skirt Congress and implement some controls administratively “an unconstitutional and unconscionable attack on the very founding principles of this republic.”
“I will seek to thwart this action by any means necessary, including but not limited to eliminating funding for implementation, defunding the White House, and even filing articles of impeachment,” Mr. Stockman said.
The paper goes on to quote Congressman Stockman as saying: “Any proposal to abuse executive power and infringe upon gun rights must be repelled with the stiffest legislative force possible ...” The article continues: “Under no circumstances whatsoever may the government take any action that disarms any peaceable person — much less without due process through an executive declaration without a vote of Congress or a ruling of a court.” This is where realism sticks its ugly head into the debate. There is virtually NO CHANCE of getting a conviction on impeachment charges against Obama through the US Senate. None.
(NOTE: IMPEACHMENT is a formal document charging a public official with misconduct in office. The House of Representatives can bring the formal charges of impeachment—but the Senate must decide the guilt or innocence.)
So, the stage is being set for a brawl. But what we are witnessing now is all Kabuki Theatre. No one should kid themselves that Obama’s people are burning the midnight oil to laboriously writing the Executive Orders so as to pass constitutional muster. No. I believe those EO’s were written long ago and only require dusting off and placing upon the public table.
The lines have been drawn now. Obama is about to find himself up against most of the republicans and a goodly number of his own political party in this fight. If he isn’t mindful, he may yet find himself in the dock for his impeachment trial before the Congress.
How ironic that would be.

According to Wikipedia: “United States Presidents issue executive orders to help officers and agencies of the executive branch manage the operations within the federal government itself. Executive orders have the full force of law, since issuances are typically made in pursuance of certain Acts of Congress, some of which specifically delegate to the President some degree of discretionary power (delegated legislation), or are believed to take authority from a power granted directly to the Executive by the Constitution.”
“However, these perceived justifications cited by Presidents when authoring Executive Orders have come under criticism for exceeding executive authority; at various times throughout U.S. history, challenges to the legal validity or justification for an order have resulted in legal proceedings.”
I am not a Constitutional scholar, but I am aware of the consequences of past executive orders. The nation now has a rogue government agency, the Environmental Protection Agency, by virtue of an executive order by President Nixon. Later, President Carter reorganized the executive branch and created a separate Department of Education. Currently, executive orders permit the President to seize control of the entire nation in the event of an attack or the declaration of a national emergency.
Now we are told that President Obama is planning to issue up to nineteen executive orders to do an end run around Congress and the Second amendment on the issue of gun control. Whereas Social Security was often referred to as “the third rail” if presidents or Congress attempted to reform it, it would appear that the Second Amendment right to keep and bear arms is the new third raid and touching it is likely to enflame both Democrats and Republicans in Congress.
Former Attorney General, Edwin Meese, recently went on record to say that the proposed executive orders would be an “impeachable offense.” There is a growing chorus of resistance to Obama’s “imperial presidency”, but whether it is the executive orders or a judgment rendered by a forthcoming Supreme Court conference, it would appear that Obama has over-reached.
The Supreme Court has scheduled a conference—not a hearing—regarding a case that challenges President Obama’s eligibility to be President. Court observers believe this will lead nowhere. If the justices were to favor elevating the case to a hearing that found Obama guilty, he could face impeachment hearings or possibly be summarily removed from office by Congress.
The Constitution says (Article II, Section 4) “The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.”
The scheduling of a Supreme Court conference to discuss a lower court case has gone virtually unreported. The case is led by an attorney, Orly Taitz, and is called Noonan,Judd, MacLaren, Taitz v Bowen. Having made it to the highest court in the land, the Taitz asserts it will provide evidence to prove that “Barack Obama using a last name not legally his, forged a Selective Service application, forged a long form and short form birth certificate, and a Connecticut Social Security number, 042-68-4425, which was never assigned to him according to E-Verify and SSNVS.”
The conference is scheduled for February 15, 2013. Obama will be sworn into office on January 21 and will deliver a State of the Union speech on February 12.
The conference arises out of a Fifth Circuit court of Appeals decision to agree to hear a petition for a Writ of mandamus to expedite a default judgment and post judgment discovery against the Commissioner of Social Security Administration, Michael J. Astrue, resulting from a previously filed case. Commissioner Astrue did not reply to Taitz’s inquiry.
If the Court finds that the evidence of forged Social Security numbers Obama is alleged to have used over the years is valid and irrefutable, it would be scheduled for a hearing, but conferences are often meetings in which cases are returned to a lower court. It has taken four years just to be discussed in conference. Despite the weight of the evidence, it may go no where.
A hearing could generate a Constitutional crisis that could lead to Obama’s impeachment and removal. It would mean that Obama was ineligible to run for office for both terms and would render his previous executive orders and the laws that he signed null and void.
Former President Nixon saw impeachment proceedings initiated in the wake of the Watergate scandal and resigned to avoid that fate. He was later pardoned by Gerald Ford. President Clinton faced an impeachment in the wake of the Lewinski affair, but Congress gave him a pass on it.
This year could initiate a political tsunami that would engulf the Congress, the Supreme Court, and the presidency.
For many the Supreme Court is seen as a politicized entity. The failure to take up the case regarding Obama’s eligibility would damage the integrity of the Court in the same way the ruling that Obamacare was a “tax” evoked a loss of faith in its judgment—or it might go unreported and the public remain unaware of it.
A constitutional crisis is looming. Only the Congress has the power to pass laws. If the President ignores Congress and issues executive orders that impose new restrictions on the Second Amendment, the people of the United States will have lost the power of the Constitution to protect them. There are already legislators prepared to initiate impeachment proceedings if he does.

Close down the weapons factories and the military bases.
Members of the armed forces should disobey orders and refuse to participate in a criminal war.

How many Obama-ordered civilian deaths in foreign lands will you tolerate before speaking out and taking action? Three Pakistani children are three too many for me.
In a blatant and unmistakable act of war against a sovereign nation, Barack Obama, four days into his administration on Friday, January 23, 2009, as commander in chief of US armed forces, ordered the US military to launch Hellfire missile strikes on homes in northwest Pakistan, killing dozens of civilians including at least three children. The military was aiming to bomb al Qaeda and Taliban “suspects,” but there was some unfortunate “collateral damage”. Oops.
Bomber pilots who leisurely drive to work each day, safely ensconced on military bases in the United States, fired the Hellfire missiles on civilians in Pakistan from unmanned, electronically controlled Predator drone aircraft. “Predator” plus “Hellfire” translates into the remote controlled explosion of children’s fragile bodies half a world away. Oh the joys of joystick bombing, the thrill of commuter combat killing, out of sight, out of mind, out of corporate US media.
The illegal air strikes and subsequent murder of civilians prompted mass protests against the US in Pakistan (a nuclear-armed nation!) and, in all likelihood, created hundreds more very angry people who are ready to do anything, anything, to defend their country, their families, and their deep sense of honor.
According to Pierre Sprey, a former Pentagon official and fighter aircraft designer,
“... what happens on the ground is for every one of those impacts you get five or ten times as many recruits for the Taliban as you’ve eliminated. The people that we’re trying to convince to become adherents to our cause have turned rigidly hostile to our cause in part because of bombing and in part because of other killing of civilians from ground forces.”So, in a spirit of bipartisanship and fair play, mindful that in the country I serve no one is above the law, I call for the impeachment of Barack Obama for war crimes, crimes against humanity, violations of the Geneva and Hague Conventions and the Nuremberg Tribunal Charter, and numerous U.N. General Assembly resolutions, just as I had called for the impeachment of Bush/Cheney for committing the very same crimes.Anyone who doesn’t think Obama should be impeached who supported the impeachment of the previous administration for these same crimes is dealing in double standards and hypocrisy. Everyone who voted for Obama has blood on his hands, especially after he made repeated campaign promises to increase already bank-busting military spending, double the number of US forces in the unwinnable US war and occupation of Afghanistan, continue to develop and deploy Reagan’s Star Wars missile “defense” system, and to “go after suspected terrorists wherever they are.”
Thanks to Democratic and Republican administrations alike, as well as to resource grabs inside developing countries by many Western nations, terrorists are now all over the world striking out against the continuing exploitation and occupation of their lands. Is Obama going to “go after” them all? With hawk-lady Clinton as Secretary of State and so many of Obama’s cabinet choices steeped in generations of promoting US aggression, I don’t doubt it.
Clinton’s appointment of Richard Holbrooke as US special envoy to Afghanistan and Pakistan is viewed by many as a recipe for disaster. Says Scott Ritter, former Marine Corp intelligence officer and U.N. weapons inspector,
“The cause-and-effect relationship between what the United States does inside Afghanistan and what occurs inside Pakistan cannot be ignored by American policymakers. He [Holbrooke] tends to seek military solutions to difficult ethnic-based problems, and he is likely to argue for the deployment of even more U.S. troops to that war-ravaged nation. That would be a historic mistake.”Obama, by surrounding himself with foreign policy hawks, is falling into the same old savage mindset: bomb first, analyze later.As for the tens of millions of Americans who expect the Obama administration to hold Bu$hCorp responsible for it’s murderous multiple felonies, don’t hold your breath. With Obama engaged in the very same activities that enraged us and the world about Bush’s neocon plans for “total global dominance” (this exact phrase appears throughout Department of Defense literature), do we really expect justice?
It speaks volumes that Obama brazenly nominated defense contractor Raytheon lobbyist William Lynn as Deputy Secretary of Defense, already waiving his own policy of not nominating industry lobbyists with conflicting interests for positions in his cabinet. So much for the “hope” to “change” the D.C. insider revolving door of military/corporate/government collusion and their perpetual war influence peddling.
Raytheon designs and manufactures some of the planet’s most barbarous devices of death and destruction that have killed hundreds of thousands of civilians and made Lynn a very rich man. Raytheon makes cluster bombs that explode on playgrounds in children’s faces long after they’ve been dropped, the Patriot anti-missile system, the Tomahawk cruise missile, Paveway laser-guided bombs, and the errant “smart bomb’ that missed its target in Baghdad in 2003 and killed at least 62 Iraqi civilians. Oops.
The Pentagon rewards Raytheon with tens of billions of our tax dollars each year to make these and newer, more lethal WMD. Lynn has been on Raytheon’s payroll since 2002. That this nomination hasn’t sent up blinding red flags and caused progressives to scream out in protest is beyond me. As long as the American Idle allow such conspicuous and flagrant travesties of justice and crimes against the peace, we, the sheeple, will continue to get exactly the government we deserve.
While Obama is making an honest attempt to deal with our many domestic crises, his foreign policy is nothing but a continuation of US imperialistic, genocidal misadventures masquerading as “homeland security” that are in actuality weaponized offenses designed to control as many of the world’s resources as we can get our grubby little hands on.
It is this material aggression and the sense of American exceptionalism for which Obama must now be held accountable. Hey – he wanted the job! Our job is to fire him if he commits crimes in the process of perpetuating the wanton greed of American empire and its supremacist, bigoted, unsustainable way of life. He has already committed the ultimate crime. Just ask the parents of those Pakistani children.
We must reach across the aisle, condemn the continuing US murder of civilians on their own soil, confront our racist attitude that our lives are worth more than theirs, and do what is right. Impeach Obama and stop the mass murder of civilians! And then continue to immediately impeach every commander in chief that commits crimes against humanity. America will be safer for it, and fewer veterans will commit suicide, and more money will be available to help the tens of millions of Americans falling into the craters of capitalism’s collapse (half of your federal tax dollars go directly to the Pentagon), and the world’s people won’t hate us so much, and precious, brown-eyed babies won’t get blown to smithereens in our name, and we might sleep a little better.
